HACC obliged the ex-deputy minister in the coal case
The Appellate Chamber of the Higher Anti-Corruption Court (HAcC) decided to apply a preventive measure in the form of a personal commitment to the former Deputy Minister of Energy and Advisor to the Minister of Energy Maksym Nemchynov.
According to the court's decision, the ruling of the Investigating Judge of HACC dated September 4, 2024 was canceled, and the prosecutor's appeal was partially satisfied. The court decided to apply a personal commitment to the suspect Nemchynov. In addition, Nemchynov is assigned the following duties: to arrive at the first request and to refrain from communication with other suspects and witnesses.
Earlier, the anti-corruption court decided not to apply a preventive measure to Nemchynov, but this decision was revised after an appeal.
Maksym Nemchynov and several other persons received suspicion from NABU and SAP. According to the investigation, in the conditions of martial law, the coal market in Ukraine was limited, and "Ukrvugilya" had to supply raw materials to the state PJSC "Centrenergo".
However, according to a conspiracy between Nemchynov and the beneficiary of a private company, the state enterprise sold almost 24,000 tons of coal to a private company that owed more than UAH 50 million. As a result, Centerenergo did not receive 12.5 thousand tons of coal and overpaid for its purchase in October 2022 by almost UAH 12 million.
