"Damage of UAH 63 million" by Andrii Gudzia

Case story: On December 19, 2024, an official of the Kyiv City State Administration was charged with official negligence, which resulted in 63 million hryvnia in losses. According to some media sources, this is Andriy Hudzys, director of the Communal Property Department of the Kyiv City State Administration.

It is noted that due to the improper performance of official duties by a municipal property official, the buildings of the covered pedestrian gallery - an elevated passage from the Central Railway Station - were illegally alienated. As a result, the capital's community suffered particularly large losses.

According to the case materials, the head of one of the departments of the Kyiv City State Administration, in compliance with the court's decision, signed a real estate purchase and sale agreement with a private entity in accordance with the requirements of the law "On the privatization of small state-owned enterprises (small privatization)."

At the same time, law enforcement officials claim that the commercial structure performed work for an amount that is less than 25% of the total cost of the facility. Also, the figures in the acts regarding the volume and cost of the work performed by the contractor did not correspond to the real ones. However, the company went to court to exercise its right to privatization and the court satisfied their claim, the police noted.

Later, under the guise of implementing the court decision to conclude an agreement, the cost of the building of the covered pedestrian gallery - an elevated passage from the Central Railway Station of Kyiv to the high-speed tram tracks, was artificially understated and illegally alienated from municipal property to private property.

It is noted that the head of one of the departments of the Kyiv City State Administration did not file an appeal against the court decision and signed the privatization order and the purchase and sale agreement. As a result of such actions, the city community suffered losses of 63 million hryvnias.

The head of one of the departments of the Kyiv City State Administration was informed of suspicion under Part 2 of Article 367 (official negligence) of the Criminal Code of Ukraine. He was also served with a petition for the election of a preventive measure. The sanction of the article incriminated to the official provides for a penalty of imprisonment for up to five years with deprivation of the right to hold certain positions or engage in certain activities for a term of up to three years.

Persons potentially involved in corruption schemes: in addition to Hudzia, representatives of a private structure with which the official signed a contract are also involved in the corruption scheme. However, their names are not available in open sources.

Assets: In his 2023 declaration, Hudz indicated that he owns an apartment and a garage in Kyiv, a summer house, and two plots of land. In addition, the official owns another apartment in joint ownership with his brother. His wife Yulia also owns an apartment in joint ownership with relatives.

Yulia Gudz also owns a Subaru Outback car worth UAH 1,075,685.

Persons who should have responded: Law enforcement agencies responded to Gudzia's criminal activities in a timely manner. However, the official is still at large.

Scandals: back in December 2022, it became known that two Kyiv City State Administration officials are suspected of negligence of one million hryvnias in the lease of the Rybalka market. The heads of the Kyiv Department of Communal Property were informed of the suspicion. According to information on the website of the Kyiv Department of Communal Property, its director since November 5, 2014 is Andriy Gudz, and the first deputy since April 4, 2016 is Oleh Shmulyar.

According to the investigation materials, an agreement was concluded between the Department of Communal Property of Kyiv and a private company on the lease of the integral property complex "Rybalka Market", located on Naberezhne Shosse Street. The rent was about 110 thousand UAH per month.

Subsequently, based on the tenant's application, the Director of the Department created a commission to inspect the condition of the entire property complex. Based on the results of the inspection, acts were drawn up on the impossibility of the tenant's use of this property due to the work to eliminate the consequences of a landslide on the shopping pavilions. These acts became the basis for the suspension of rent from December 2018 to October 2019.

However, it was established that the preparation of such acts is not provided for by current legislation, and the procedure for resolving disputes regarding the suitability of the object for lease falls within the jurisdiction of the court.

In addition, it turned out that during the work to eliminate the consequences of the landslide, municipal property was dismantled and dismantled - metal structures, a pavilion and a fence. However, as the investigation established, there was no need to remove the market equipment, and therefore, in the period from October 2018 to October 2019, the entire property complex could be used for its intended purpose.

As a result of the dishonest performance of official duties to ensure control over the fulfillment of the terms of the concluded contract, as well as the release of the tenant from rent in a manner not provided for by law, the territorial community of the city of Kyiv suffered material damage in the amount of 1 million 112 thousand UAH in the form of unpaid monthly rent payments. However, further development of this case was "on pause".
