"Corruption in the Removal of Arrest from Funds" by Tatyana Ilyeva

Position: Judge of the Pechersky District Court of Kyiv.

Qualification: the judge's actions are qualified under Part 2 of Article 364, Part 1 of Article 366 of the Criminal Code of Ukraine.

Status: at large.

Case story: in March 2023, the National Anti-Corruption Bureau and the Specialized Anti-Corruption Prosecutor's Office reported suspicions to Tetyana Ilyeva, a judge of the Pecherskyi District Court of Kyiv.

As journalists reported, judges have charged Ilyeva with abuse of office. According to the investigation, Pechersk District Court judge Tetyana Ilyeva illegally lifted the arrest of the funds of Andriy Mykhaniv, the former vice-president of the state-owned company Khlib Ukrainy. He himself is accused of helping former Prime Minister Pavlo Lazarenko legalize funds of criminal origin.

Il'eva canceled the arrest as an investigating judge, although the case is already being heard on the merits and the motion to lift the arrest was to be heard by the panel of judges considering Mykhaniv's case. On the day the arrest was canceled, 110.7 thousand euros and 9.3 thousand dollars that were in the former employee's bank account were withdrawn.

Later, the SAPO confirmed that the suspicion had been served on a judge of one of the district courts in Kyiv.

Currently, the SAPO has prepared a petition to the High Council of Justice for the temporary suspension of the judge from the administration of justice, as well as to the High Court of Justice for the application of a preventive measure in the form of bail to her. The pre-trial investigation is ongoing. Other persons allegedly involved in the commission of the crime are being identified

After the announcement of suspicion against Judge Ilyeva, the High Council of Justice refused to suspend her from the administration of justice, despite all the factors in favor. Only three members of the High Council of Justice out of 17 present voted in favor. It was only a question of temporarily suspending the judge from work for the duration of the investigation.

On April 17, 2023, the High Anti-Corruption Court applied a preventive measure to Judge Ilyeva - 805 thousand hryvnias of bail, although the NABU detective requested 4 million. Currently, bail has been posted for the judge and she is under arrest.

In January 2025, the Director of NABU filed a complaint with the High Council of Justice with a request to hold a judge of the Pecherskyi District Court of Kyiv accountable.

It is reported that during the investigation into possible abuses by officials of the judicial system and law enforcement agencies, it was established that at the end of 2023, this judge made a number of decisions about which there are objective doubts as to their compliance with the norms of the law.

These are cases regarding the return of money seized during the investigation. In the first case, the judge made a decision, thanks to which the money seized during the search was not received by the owner, but by a third party who had no connection to these funds. In the second case, the situation was similar: the seized money was returned to another party who had no right to these funds. In general, two amounts are at stake: over 4.1 million UAH and over 15 million UAH

At the same time, the same judge of the Pechersk District Court had already made such questionable decisions that were the subject of previous complaints to the High Council of Justice, the Bureau added.

Persons potentially involved in corruption schemes: in addition to Ilyeva, the scheme also involves former vice-president of the state-owned company "Khlib Ukrainy" Andriy Mykhaniv.

Assets: In her 2023 tax return, Ileva stated that she owns an apartment in Kyiv, as well as a land plot and a house in the Kyiv region. Other real estate, including an apartment and a land plot, is owned by her husband Maksym.

In addition, during the full-scale war, Ileva purchased a new car - a Toyota Land Cruiser 200 for almost 1.5 million hryvnias.

Ilyeva's income for the second year of the full-scale war was UAH 1,496,775, and her husband Maksym's was UAH 792,381.

Tetyana Ilyeva declared $62,000 in cash, and UAH 106,752 in her bank accounts. At the same time, the official's husband indicated $208,000 in cash, and UAH 548,930 in his bank accounts.

Persons who should have reacted: Law enforcement agencies responded promptly to Ilyeva's criminal activities by filing a charge. However, the judge has not yet been suspended from administering justice.

Scandals: in 2021, Bihus.Info journalists reported that the family of Tetyana Ilyeva, a judge of the Pechersk District Court of Kyiv, whose office was searched by the NABU on October 20 of the same year, is building a house near Kyiv and uses expensive SUVs. In addition, the judge's family does not have official commensurate wealth.

Yes, at that time, Ileva had an estate in Khotyanivka of 264 square meters. Another house was being built next to it - a little smaller. The judge's declaration indicated that the construction of the estate cost the same as a two-room apartment on the outskirts of Kyiv - 1.8 million UAH. But officially, the judge did not have this money either, so, at a time when construction was already underway, Ileva first declared 1 million UAH, and then another 1.5 million as alleged gifts from her mother.

Iliev Sr. lives in Mogilev-Podilskyi and, according to local residents, the woman sells pies at the local market. In addition to trading, the judge's mother is engaged in farming and has about 50 hectares of land in her possession. But over 10 years, this activity has officially brought her a little more than 20 thousand dollars.

The land under the house where the judge's family lives was also given as a gift. 24 acres in Khotyanivka, which are worth approximately UAH 2.5 million on the market, were allegedly given to Ileva by her aunt. The latter also lives in Mohyliv-Podilskyi and is engaged in farming and trade according to documents. In addition to real estate, the judge's family also owns expensive cars. In particular, in early November 2021, the judge bought a Range Rover. On sales sites, such cars cost from half a million hryvnias. Interestingly, the Range became Ileva's third car that year. Before that, the judge drove a Mercedes G-class and a BMW X5.

Ileva's daughter has a Land Cruiser 200 registered, the market price of which starts at one and a half million hryvnias. At the time of buying the car, the girl had just graduated from university and officially did not have a commensurate income. Ileva refused to explain and comment on the origin of the funds for expensive real estate, cars and gifts from her mother.
