It is punishable by a fine from one thousand to four thousand non-taxable minimum incomes of citizens or restriction of liberty for a period of two to four years, or deprivation of liberty for the same period.
Status: serving sentence in prison.
The plot of the case: according to the indictment, in the spring of 2021, former deputy head of the Ministry of Defense Dmytro Komaha promised to transfer funds in the amount of UAH 16.8 million to the director of the internal audit department of the Ministry of Defense from a commercial company.
This company performs work on the reconstruction of the underground part of the building of one of the central offices under the Unified Security Center for the Ministry of Defense within the framework of the state defense order.
According to the investigation, the funds were allocated for a positive audit opinion regarding the conformity, completeness and quality of the equipment supplied by the commercial company to the terms of the state contract.
The official of the military representative office valued his "services" at UAH 7 million - that's how much he should have received for his "mediation" between the commercial company and the director of the internal audit department. In general, it is about UAH 24 million.
According to NABU, a positive audit conclusion would allow the private company to receive the full amount of payment under the concluded contract, the total value of which is more than UAH 400 million, and to apply for the conclusion of subsequent contracts for the arrangement of other parts of the system.
In March 2023, the High Anti-Corruption Court sentenced Komasi to 4.5 years in prison, however, the defense filed an appeal against this sentence.
In November 2023, the Appellate Chamber of the High Anti-Corruption Court upheld the sentence, which carries up to 4.5 years of imprisonment.
He is currently serving his sentence in prison.
Subsequently, the convict filed a complaint with the Supreme Court, which decided in 2024 that it would consider the complaint.
"Open cassation proceedings based on the cassation appeal of the convicted (Komahy - ed.) against the verdict of the Higher Anti-Corruption Court dated March 24, 2023 and the decision of the Appeals Chamber of the Higher Anti-Corruption Court dated November 9, 2023," the decision reads.
Persons potentially involved in corruption: there is no information in open sources regarding persons who may be alleged accomplices of the perpetrator.
Assets: in the declaration upon his release, Komah indicated that he has two plots of land, and jointly owned an apartment with his wife.
He also owns a 2012 Honda CRV, priced at UAH 317,000, and a 2020 Mazda CX-5, priced at UAH 765,000.
In addition, he indicated that he received UAH 556,436 in salary from his main place of work and UAH 148,936 in pension.
Komaha declared UAH 300,000 in a bank account, while his wife has UAH 600,000 in a bank account.
Scandals: in open sources there is no information about other scandals in which Dmytro Komaha appears.
