"Forgot to declare 1,6 million"

Status: case closed. At the moment Lysyy is at liberty.

The plot of the case: in February 2023, the National Anti-Corruption Bureau announced the search for the deputy chairman of the Sumy Regional Council, Vadym Lysy. He is suspected of not declaring a $60,000 loan.

"NABU is looking for the deputy chairman of the Sumy Regional Council on suspicion of non-declaration in criminal proceedings No. 42022000000000041 dated February 8, 2022. Lysiy Vadim Viktorovych, born on August 22, 1983, is suspected of having committed the crime provided for in Part 1 of Art. 366-2 of the Criminal Code of Ukraine", the message read.

The investigation established that the suspected deputy chairman of the Sumy Regional Council, Vadym Lysiy, did not declare a loan received in 2017 in the amount of UAH 1.6 million (equivalent to $60,000 on the date of signing the contract), which he took as collateral for a non-residential premises with an area of ​​more than 520 square meters in Sumy.

True, the case was closed already in July 2023.

As indicated in the document, the accused Lysyy filed a motion to release him from criminal liability, since the terms of the case expired on April 15, 2023.

The court established that the deadlines in the case were suspended in connection with the search for the accused. As established, Lysyy did not appear for numerous summonses to NABU, he did not warn about the reasons for his non-appearance.

In addition, the accused did not provide evidence that he was on sick leave. Instead, it was done by NABU detectives, at whose request they provided confirmation of Lysy's treatment. The detectives also found correspondence between the deputy chairman of the Sumy Regional Council and the director of the Kharkiv Territorial Department of NABU. Lysiy allegedly tried to avoid the obligation to appear at the detective's summons in an extra-procedural way.

In the correspondence, the accused was indignant at the NABU's actions regarding the methods of summoning him. Lysyy emphasized that his absences are related to the organization of the work of the rapid response group and that the improper organization of the work of the State Security Service may lead to the fact that "martyrs" will fly to Kyiv.

"Satisfy the petition of the accused. Exonerate from criminal responsibility due to the expiration of the statute of limitations (Vadim Lysygo - ed.), who is accused of committing a criminal misdemeanor, provided for in Part 1 of Art. 366-2 of the Criminal Code of Ukraine. Close the criminal proceedings on the basis of paragraph 1, part 2 of Article 284 of the Criminal Procedure Code of Ukraine in connection with the release of a person from criminal responsibility," the decision reads.

In December 2023, in a "magical" way, the company of the chairman of the Sumy Regional Council Viktor Fedorchenko, whose deputy is Vadym Lysyy, won the tender for the construction of a platoon base in the Sumy region for almost 46 million UAH.

This is stated on the public procurement website Prozorro.

According to the information posted on the website, the tender for the construction of the VOP was won by BVK Company "Fedorchenko" LLC.

The company was founded in 1990 by the current chairman of the Sumy Regional Council, Viktor Fedorchenko. This is stated on the company's website.

In December 2020, his son, Dmytro Viktorovych Fedorchenko, was appointed general director of BVK company "Fedorchenko" LLC. It was then (December 3, 2020) that Viktor Fedorchenko was appointed chairman of the Sumy Regional Council.

The contract with the company in the amount of UAH 45,851,553.17 was concluded on December 7, 2023.

Wealth: Vadym Lysy's declaration does not include elite luxury items, such as diamond cufflinks or gold bars. However, the declaration for 2022 states that the deputy chairman of the Sumy Regional Council has 4,940,000 million UAH in cash and 171,000 thousand dollars.

Persons who should have responded to corruption schemes during his tenure: in the case of Lysy, all law enforcement agencies responded in time and identified corruption risks.

Scandals: on January 27, 2023, an official's car was stopped for violating curfew rules. During the conversation with the driver, signs of alcohol intoxication were found in him, as claimed by the patrolmen. Vadym Lysyy did not pass a medical examination for intoxication.

The court found guilty the first deputy chairman of the Sumy Regional Council. 

One year of deprivation of the right to drive vehicles, a fine of UAH 17,000 and a court fee of UAH 536 — such a sentence was announced in court.
