Case story: in the winter of 2023, the Lutsk court fined a psychiatrist from the Manevytsia Hospital, Anatoliy Malyarchuk, who demanded $1,700 from a draft evader. The doctor was supposed to help the draft evader obtain a certificate of unfitness for service. He was supposed to transfer part of the amount to members of the military medical commission, but he did not do this, and as a result, the draft evader never received the certificate. Anatoliy Malyarchuk was charged with violating three articles of the Criminal Code of Ukraine, but the court found him not guilty of two: smuggling people across the border and inciting to give a bribe. At the same time, he was found guilty under the article on fraud and was given the minimum penalty - a fine of UAH 34,000.
In court, the draft evader said that he arrived in Volyn from Poltava region in May 2022, temporarily living in Manevychy. He was looking for an opportunity to go abroad, and an acquaintance advised him to contact the psychiatrist of Manevychy Hospital, Anatoliy Malyarchuk. The doctor assured that he would be able to help issue a certificate of unfitness for service, which would be the basis for unhindered departure from Ukraine.
On June 23, in the village of Lypyny near Lutsk, an immigrant handed over the main amount to a doctor: $1,200, which the psychiatrist was supposed to give to two doctors at the regional psychiatric hospital for issuing a certificate of unfitness for military service. On the same day, he gave the psychiatrist another $500, but was then detained by law enforcement officers. As it turned out, the immigrant had contacted the police even earlier, because he suspected that the doctor would not issue any certificate.
The accused Anatoliy Malyarchuk only partially admitted his guilt: he only admitted that he had extorted money for his own enrichment, and did not intend to fulfill his promises. “I did not agree with anyone about declaring [the displaced person] unfit for military service, I simply advised the victim on how to behave, what to tell the doctors, I did not transfer the funds to any of them and did not intend to do so, since I wanted to appropriate them all. I did not have the authority to influence the commission’s decision. With my words and behavior [...] I tried to convince the victim that I could resolve these issues, I did this to give more pathos and so that the victim would not doubt what I was telling him,” the accused testified in court.
So Anatoliy Malyarchuk pleaded guilty only to fraud, but at the same time noted that he committed the crime only because of the provocation of the evader himself.
Judge Alla Polyushko acquitted the psychiatrist on the articles on smuggling people across the border and accepting a bribe. “The accused had no real intention to assist in providing [the evader] with the appropriate document that would remove legal obstacles to traveling abroad; he could not independently make such a diagnosis and issue the appropriate document; he did not agree with anyone who was authorized to make such a decision, therefore the qualification of his actions under the specified article is also excluded,” the verdict of the Lutsk City District Court states.
At the same time, he was found guilty under the article on fraud and was given the minimum punishment under this article: a fine of 34 thousand UAH. The bribe in the amount of 1,700 dollars will be returned to the evader. In addition, the doctor will have to pay 7.5 thousand UAH for examinations.
Later, in the spring of 2025, the Manevytskyi District Court of the Volyn region sentenced psychiatrist Anatoly Malyarchuk, who demanded a 5,000 UAH bribe from a patient for processing documents on the establishment of care. The defendant was exposed for the second time in corruption. He was fined 8,500 UAH for his actions.
As stated in the verdict of April 2, Anatoliy Malyarchuk has been working as a psychiatrist at the Manevytska Multidisciplinary Hospital since 2016. The defendant's duties include, in particular, issuing conclusions to residents of the district who are undergoing a medical examination. Thus, on April 4, 2023, Anatoliy Malyarchuk informed the patient who was drawing up documents on the establishment of care that for a bribe of 5,000 UAH he would not create additional obstacles. After that, the defendant received the entire amount.
Anatoliy Malyarchuk pleaded guilty and entered into a plea agreement with the prosecutor.
Judge Ruslan Onysko found Anatoliy Malyarchuk guilty of Part 4 of Article 354 of the Criminal Code of Ukraine (bribery of an employee of an enterprise, institution or organization) and imposed a fine of UAH 8,500.
