Case story : In December 2023, the Main Investigation Department of the SSU uncovered a scheme of alleged abuse in the procurement of artillery shells for the Armed Forces of Ukraine. Suspicion in this case fell on the head of the Main Department for the Production of Ammunition and Construction of Fortifications of the Ministry of Defense, Oleksandr Nagorsky.
The Specialized Prosecutor's Office in the Defense Sector initially charged the employee with a crime under Part 2 of Article 114-1. And a little later, in August 2024, the prosecutor's office added Part 2 of Article 364 of the Criminal Code of Ukraine, that is, a corruption article, to the qualification. All because, according to the investigation, in December 2022, despite having a more favorable contract for the purchase of ammunition from the manufacturer — at a better price and faster delivery times — Nagorsky extended the contract with an intermediary company, which, moreover, had previously delayed the fulfillment of orders from the Ministry of Defense.
As a result, UAH 1.5 billion was transferred to the accounts of the intermediary company. This exceeded the cost of products under a direct contract with the manufacturer by UAH 130 million.
However, in September the case was closed due to the expiration of the pre-trial investigation period, i.e., "Lozovoy's corrections."
It is known that after the suspicion was served, Nagorsky's case was transferred to the Specialized Anti-Corruption Prosecutor's Office and the National Anti-Corruption Bureau. However, the SAPO prosecutor returned it because the SSU investigators did not collect enough evidence to confirm the elements of the crime.
The case was returned to the Prosecutor General's Office, after which the Prosecutor General again determined that the SBU was responsible for the investigation. After that, the SSU and the Prosecutor General's Office extended the terms of the pre-trial investigation through the Shevchenko Court, despite the fact that they knew that such a request should be considered by the Supreme Court of Justice.
Since the wrong court extended the deadline, the case was referred to the Supreme Court of Justice for consideration after the pre-trial investigation period had expired. As a result, it was not even considered to the end.
In early October 2025, the High Anti-Corruption Court closed the criminal case against Oleksandr Nagorsky, head of the Main Department for Organizing the Production of Ammunition and Construction of Special Purpose Structures of the Ministry of Defense, who was accused of embezzling money during the purchase of artillery shells. The reason for this was the "Lozovoi corrections."
