"Land Scheme" by Mykola Shmayun

Position: former head of the Shchaslyvska village council, Boryspil district, Kyiv region.

Sphere of corrupt activity: purchase of land plots.

Region of corruption activity: Kyiv region.

Qualification: the actions of the former official were qualified under Part 5 of Article 191 of the Criminal Code of Ukraine.

Case story: NABU and SAPO reported suspicions against four individuals for causing over UAH 7.8 million in damages to the territorial community. These are the former head of the Shchaslyvska Village Council of the Kyiv region and three of his accomplices, namely a property owner, an appraiser, and a mediator.

According to the investigation, in the spring of 2019, the then head of the village council purchased an abandoned building with three land plots with an area of ​​0.81 hectares for the needs of the village for UAH 15.8 million. However, a month earlier, the participant in the crime purchased this property for only about UAH 2 million.

To implement the criminal plan, reports on the valuation of the building and land plots were forged. An examination conducted as part of the investigation established an illegal overpayment of more than 7.8 million UAH.

In June 2023, the Supreme Anti-Corruption Court took Mykola Shmayun into custody.

The request of the senior detective of the NABU to apply a preventive measure to the suspect is partially granted. To apply a preventive measure in the form of detention to the suspect Mykola Shmayun for 60 days, i.e. until August 11, 2023 inclusive. To take the suspect into custody in the courtroom

– the judge announced.

At the same time, the Supreme Court of Ukraine has determined an alternative for him in the form of UAH 4.562 million bail. In the event of bail, Shmayun will be imposed a number of obligations: to appear upon request; not to leave Kyiv and Kyiv region without permission; to report any change in his place of residence and place of work; to hand over his foreign passports and to refrain from communicating with other suspects in the case and other persons.

The Appellate Chamber of the High Anti-Corruption Court also applied a preventive measure to appraiser Larysa Yarema in the form of a UAH 268,400 bond with obligations. She is suspected of involvement in causing over UAH 7.8 million in losses to the Shchaslyvska Village Council of the Boryspil district of the Kyiv region.

She was given the following obligations: to appear upon request; not to leave Kyiv and the Kyiv region without permission; to report any change in her place of residence and place of work; to hand over her foreign passports and to refrain from communicating with other suspects in the case and other persons.

In addition, the Appeals Chamber of the Supreme Court of Ukraine set a bail of UAH 214,720 for the mediator Antonina Grebenyuk. She was also given the same list of responsibilities.

Subsequently, NABU and SAPO completed the investigation into the former head of the Shchaslyvska village council Mykola Shmayun. At the same time, the materials regarding three other suspects, namely: Antonina Hrebenyuk, appraiser Larisa Yarema, and accomplice Ashot Mkrtchyan, were allocated to a separate proceeding, and the investigation was stopped there.

In January 2025, the Supreme Anti-Corruption Court scheduled the criminal proceedings against Shmayun and two other individuals for consideration on the merits.

To schedule an open court session for the trial in criminal proceedings on charges of: (Shmayun – ed.) committing a criminal offense under Part 5 of Article 191 of the Criminal Code of Ukraine; (Antonina Hrebenyuk – ed.) committing a criminal offense under Part 3 of Article 27, Part 3 of Article 358 of the Criminal Code of Ukraine; (Arena Mkrtichyana – ed.) committing a criminal offense under Part 5 of Article 191, Part 4 of Article 358 of the Criminal Code of Ukraine

– the decision states.

Individuals potentially involved in corruption schemes: intermediary Antonina Hrebenyuk, appraiser Larisa Yarema, and accomplice Ashot Mkrtchyan.

Assets: While serving as a deputy, Shmayun indicated in his 2023 declaration that he owned a residential building, three land plots, and four non-residential premises. At the same time, his wife Olga owns an apartment, four land plots, and non-residential premises.

Mykola Shmayun also declared a Volkswagen Touareg car, without specifying the cost.

Shmayun's income for 2023 was UAH 1,518,084, and his wife's was UAH 2,152,183.

Shmayun declared 500,000 UAH and 20,000 USD in cash, and 84,414 UAH in his bank accounts. At the same time, his wife Olga declared 600,000 UAH and 40,000 USD in cash, and 1,362,334 UAH in her bank account.

Persons who should have reacted: law enforcement agencies responded in a timely manner to the criminal activities of Shmayun and his accomplices.

Scandals: Before the corruption scheme, he was not seen as a figure in other scandals.
