"Scheme at the Tender" by Marian Yavorsky

Qualification: the official's actions were qualified by Part 3 of Article 369 of the Criminal Code of Ukraine.

Case story: On January 9, 2025, police officers detained Volodymyr Bayda, the head of the education department of the Yavoriv City Council in the Lviv region, on suspicion of bribery. For a bribe of UAH 800,000, the official promised to ensure victory in the tender for entrepreneurs.

According to law enforcement officials, the head of the education department, Volodymyr Bayda, demanded a kickback from the business entity for giving an advantage in determining the winner of the tender and concluding contracts. The case concerned the purchase of office supplies.

According to media reports, the head of the education department was detained red-handed in his office on the evening of January 9. The bribe was seized by law enforcement officers.

The Halytskyi District Court of Lviv chose a preventive measure for suspect Volodymyr Baida in the form of detention with the alternative of paying UAH 908,000 in bail.

The Strategic Investigations Department of the National Police reported details of the detention of Volodymyr Bayda for bribery. It turned out that he received a bribe of UAH 821 from a deputy of the Starosambir City Council, local businessman Marian Yavorsky, who lobbied for the interests of commercial structures in a tender.

As reported by the Strategic Investigations Department of the National Police, deputies of the Starosambir and Yavoriv city councils in the Lviv region are involved in the corruption scheme. They were involved in concluding contracts for the purchase of goods and services using budget funds.

One of the defendants lobbied for the interests of certain commercial structures, and the other (the head of the education department – ​​Ed.) ensured their victory in government procurements. The reward was 5-10% of the total amount of the concluded contracts. Currently, investigators have informed both defendants of suspicion

– the department's statement says.

Both detainees were informed of the suspicions. Deputy of the Yavoriv City Council Volodymyr Baida for receiving unlawful benefit (Part 4 of Article 368 of the Criminal Code of Ukraine), and deputy of the Starosambir City Council Maryan Yavorsky – for providing unlawful benefit (Part 3 of Article 369 of the Criminal Code of Ukraine). The sanctions of the articles provide for punishment in the form of imprisonment for a term of up to 12 and 8 years, respectively.

Persons potentially involved in corruption schemes: deputies of the Starosambir and Yavoriv city councils in the Lviv region are involved in the corruption scheme. In particular, deputy Maryan Yavorsky.

Assets: in his 2023 tax declaration, Yavorsky indicated that he owns a residential building and a land plot, as does his wife Tetyana.

The official also owns a Toyota Rav4 car and a Mercedes-Benz truck (total value - UAH 884,918). His wife owns a Nissan Juke and a trailer.

Yavorsky's income for 2023 was UAH 3,564,318, and his wife Tetyana's was UAH 5,617,100. At the same time, the couple did not declare any monetary assets.

Persons who should have reacted: law enforcement agencies responded in a timely manner to the criminal activities of Yavorsky and Bayda, handing both of them suspicions. 

Scandals : Before the corruption scheme, Yavorsky was not seen as a figure in other scandals.
