The plot of the case: the head of the medical and social expert commission Lubomir Zavyaltsia. was detained in October 2021 for bribery and abuse of influence. For 700 dollars, he guaranteed to draw up documents for the establishment of II disability group. At the same time, his accomplice was also detained. He asked for 400 dollars for his "services". He promised his acquaintance that he would be able to influence the members of MSEK to give the woman the status of disability. They and an accomplice asked for 1 thousand 100 dollars for their services. The accomplice received the money on October 26, 2021, on Pilotska on the territory of the regional hospital. He immediately gave 400 dollars to Zavyaltsy, and kept another 400 for himself. There is no mention of the fate of the remaining $300. Cops arrested the bribe-takers on the same day.
At the court, Lubomyr Zavyalets did not admit his guilt. He said that it was simply a debt for previously purchased tree seedlings. During the investigation, the case was reclassified as abuse of influence. However, during the trial, the head of the commission was acquitted because they could not prove his guilt.
In December 2023, the Khmelnytskyi Court of Appeal overturned the acquittal and sentenced Lubomir Zavyaltsy to two years in prison. The appeal confirmed the version of the investigation that the accused head of the MSEK together with an accomplice received a $1,100 bribe from a citizen for influencing the members of the Khmelnytskyi MSEK in order to make a decision on issuing her the II disability group for three years. The appeal verdict in May 2024 was upheld by the Supreme Court.
At the same time, the former head of MSEС Lubomyr Zavyalets, after the appeal verdict, asked the court to postpone the punishment, because he fell ill with a serious illness. However, Themis refused the request. The doctor served his sentence in the Khmelnytskyi detention center. In October 2024, it became known that Zavyalets expressed a desire to undergo military service under a contract. The court approved the application for conditional early release from serving the sentence to the exhibitor.
As a result, Lyubomir Zavyalts was released early from serving his sentence and handed over to the National Guardsmen for escort to the military unit with which he had signed a contract. If it were not for mobilization, the convict would have had to spend another year and four months in prison.
It is noted that the exhibitor will be subject to administrative supervision throughout the year. In particular, the former head of the MSEK is prohibited from staying outside the military unit's location and without the commander's permission to travel outside the military unit's location on personal matters.
