Case story: On July 26, 2022, NABU and SAPO detained an operative of the SBU department, Serhiy Shcherbakovsky, “red-handed”. According to the investigation, he demanded and received $60,000 for allegedly assisting in the return of equipment seized as part of the investigation into the theft of electricity in eastern Ukraine, as well as not obstructing business operations. The equipment was seized and soon the entrepreneur-owner of the equipment was made an “offer”, which he reported to NABU.
Subsequently, the anti-corruption court arrested Shcherbakovsky with an alternative of almost UAH 1.98 million. In connection with the bail, the SBU operative was assigned the following obligations: to appear upon every request; not to leave the city of Kyiv without permission; to report any change of his place of residence and/or place of work; to refrain from communicating with a number of persons and to hand over his foreign passports for safekeeping.
In November 2024, the anti-corruption court found Shcherbakovsky guilty of receiving illegal benefits and sentenced him to 10 years in prison with confiscation of property.
The defendant's defense lawyers filed an appeal against this verdict. In January 2025, it became known that the Appellate Chamber of the High Anti-Corruption Court would consider an appeal against the verdict sentencing Serhiy Shcherbakovsky, an operational officer of the Department of Counterintelligence Protection of State Interests in the Field of Information Security of the Security Service of Ukraine, to 10 years in prison.

The Appeals Chamber of the High Anti-Corruption Court has suspended the hearing of an appeal against the verdict sentencing Serhiy Shcherbakovsky, an operational officer of the Department of Counterintelligence Protection of State Interests in the Field of Information Security of the Security Service of Ukraine, to 10 years in prison. He resigned from the SSU and mobilized into the National Guard.
As is known, the anti-corruption court found Shcherbakovsky guilty of receiving illegal benefits and sentenced him to 10 years in prison with confiscation of property. The defendant's defense lawyers have filed appeals against this verdict.
During the consideration of the complaint, it became clear that Shcherbakovsky had resigned from the SSU and mobilized into the National Guard. His defense attorney requested that the case be stayed until martial law ends or the defendant is released from military service.
The motion is granted. To suspend the trial in the case on the appeals of the defendant's (Shcherbakovsky) defense lawyers against the verdict of the High Anti-Corruption Court of 11/27/2024 in criminal proceedings, until the end of martial law in the country or the termination of military service
The decision was made by a panel of judges consisting of: presiding judge Inna Kalugina, judges Viktor Pankulych and Mykola Glotov.
At the same time, Judge Glotov issued a separate opinion and disagreed with the decision of the panel. He noted that during the trial in the court of appeal, Shcherbakovsky never arrived at the court sessions. In March 2025, the defense requested a suspension of the case, since the accused is serving in the military service in the Department of the Security Service of Ukraine in the Zaporizhia region. However, he was refused, since Shcherbakovsky was not called up for military service during mobilization.
On June 16, the accused was released from the SSU due to family circumstances: the person independently raises and supports a child by court decision. This is also the reason why the accused cannot be mobilized into the Armed Forces of Ukraine. But already on June 21, based on Shcherbakovsky's report, he was enrolled in the personnel lists of one of the NSU units. Therefore, according to Glotov, the accused is abusing his rights in order to delay the trial and stop the case.
