Appeal Overturns Return of Customs Head’s Case image

The Appeals Chamber of the High Anti-Corruption Court has overturned the decision of a judge of the High Anti-Corruption Court to return to the prosecutor of the Specialized Anti-Corruption Prosecutor's Office the indictment against the acting head of the State Customs Service, Serhiy Zvyagintsev, for false declaration. As is known, on September 12, Judge Larysa Zadorozhna returned the indictment against Zvyagintsev to the SAPO prosecutor. The prosecutor filed an appeal against this decision.

The appeal shall be granted. The decision of the judge of the HACC dated September 12, 2025 on the return to the prosecutor of the indictment with the amended charge in criminal proceedings on the charge (Zvyagintseva - ed.) of committing criminal offenses provided for in Part 1 of Article 366-2 of the Criminal Code shall be canceled with the appointment of a new trial in the court of first instance from the stage of the preparatory court session.

As is known, the anti-corruption court set a bail of UAH 60,560 for the head of the State Customs Service. Zvyagintsev was also given the following obligations: to appear upon every request; to report any change in his place of residence and place of work; to refrain from communicating with a number of persons and to hand over his international passports for safekeeping.

As a reminder, NABU and SAPO reported the suspicion of the acting head of the State Customs Service, Serhiy Zvyagintsev. According to the investigation, in 2021–2023, the suspect did not reflect in the declaration information about a residential building near Kyiv with an area of ​​236.8 square meters and the land plot on which it is located.

The investigation established that the official registered real estate worth over $100,000 in the name of his wife's father, although in reality the actual owner is he and his family.
