The SBI reported that Tupytsky was suspected of fleeing across the border
The State Bureau of Investigation (SBI) reported the suspicion to the former head of the Constitutional Court of Ukraine and several border guards who, according to the investigation, could have contributed to the judge's flight abroad. The name of the suspect is not disclosed in the message, but the circumstances of the case indicate that it is Oleksandr Tupytskyi.
According to the investigation, the act was organized by a criminal group, which included the deputy chief of one of the district police departments of the Zakarpattia region and employees of the State Border Service. They were charged under Part 3 of Article 332 of the Criminal Code of Ukraine (illegal transportation of persons across the state border of Ukraine).
The former head of the Constitutional Court became one of those who used this illegal service.
Investigators established that the perpetrators ensured that citizens of Ukraine crossed the state border through separate checkpoints in the Berehiv district of the Zakarpattia region without properly passing border control.
The police officer, in accordance with his role, informed persons who tried to leave Ukraine illegally about the method of crossing the border and coordinated the actions of the drivers who carried out the transportation. The law enforcement officer personally went to the area of the border post, accompanying the illegal crossing of the state border, including at night. In turn, border guards did not carry out border control of persons who were illegally transported across the state border of Ukraine
Within the framework of this criminal proceeding, Oleksandr Tupytskyi is also suspected of complicity with an organized group in the illegal transportation of persons across the state border of Ukraine under Part 2 of Article 332 of the Criminal Code of Ukraine. The investigation is ongoing.
