Kyiv City Administration official to face trial over building repairs

Prosecutors have sent an indictment to the Shevchenkivskyi District Court in the case of embezzlement of budget funds during the renovation of the privatized building of the enterprise "ATP KSCA". The head of the Kyiv City State Administration (KCSA) staff, Dmytro Zagumenny, and the former head of the utility company will appear before the court.
This was reported by the Kyiv City Prosecutor's Office.
During the pre-trial investigation, law enforcement officers established that two officials ordered and paid for facade improvements and other repairs to an office building on Borys Grinchenko Street. At the same time, the building had already been privatized at that time.
In total, the defendants spent almost 1.3 million hryvnias on repairs. At the same time, the utility company does not even have lease agreements for the renovated premises, the prosecutor's office noted.
The actions of the officials were qualified under Part 5 of Article 191 of the Criminal Code of Ukraine - embezzlement of property through abuse of official position by an official, committed by a group of persons in a prior conspiracy, on a particularly large scale. The sanction of the article provides for a penalty of imprisonment for a term of up to 12 years.
The specified building was removed from municipal ownership under a purchase and sale agreement in 2010. At the same time, the new owner did not actually assume his rights, the municipal enterprise continued to use the building and even make money from it.
According to them, in 2019, the facade of the building was in poor condition and posed a danger to visitors and passers-by. Therefore, it was repaired. Because of this, Zagumenny was awarded over 1.2 million hryvnias in embezzlement, since at the time of its implementation, the building was not in municipal ownership.
According to the lawyers, this case bears signs of political persecution. They explained this, in particular, by the fact that "the investigation ignored the fact that the utility company continues to actually use the building and in 2019 earned more than 41,000,000 UAH from it. Against the background of this profit, the repair costs in the amount of 1,279,058.09 UAH. look more than justified." The official's defense also noted that the investigators did not establish a motive and did not question witnesses.
