HACC Closes Case Against Two Former National Guard Officials
The High Anti-Corruption Court has acquitted the former head of the Department of Quartering and Capital Construction of Logistics of the Main Directorate of the National Guard, Leonid Sikora, and the former head of the financial department of the same department of the Main Directorate of the National Guard, Mykola Modlinsky, from criminal liability due to the expiration of the statute of limitations.
The defendants' defense lawyers requested that their clients be released from liability and the case be closed due to the expiration of the statute of limitations (December 2023). The court upheld the motion.
To release the accused (Sikora – ed.) from criminal liability on charges of committing a criminal offense provided for in Part 2 of Article 367 of the Criminal Code of Ukraine, on the basis of Article 49 of the Criminal Code of Ukraine in connection with the expiration of the limitation periods and to close the criminal proceedings in this part on the basis of Part 1 of Part 2 of Article 284 of the Criminal Procedure Code of Ukraine.

Recall, according to the prosecution, developer Andriy Nemeryuk organized a scheme to seize UAH 17.3 million from the NGU, which were allocated from the state budget for the purchase of housing for NGU servicemen. As detectives established, he involved in his plan the head of the department of quartering and capital construction of logistics of the Main Department of the NGU Leonid Sikora, the head of the financial department of the same department of the NGU Modlinsky, the director of LLC "Buchazhytlobud-Credit" Dmytro Lashkovitser, and the head of the housing and communal service "Buchazhytlobud No. 1" Oleg Voynalovich.
These individuals also involved the deputy head of the Department of Quartering and Capital Construction of Logistics of the Main Directorate of the National Guard, Oleksandr Yarosh, in committing the crime. However, as the investigation found out, he was not part of the group.
To implement the plan, they secured the victory of LLC "Buchazhytlobud-Credit" to purchase apartments from them in Bucha, Kyiv region, namely the Forest Land residential complex. To date, the apartment purchase agreements have not been executed due to the unsuitability of the apartments for living. Nemeryuk and the head of the financial department of NSU are wanted. They were served with suspicion in absentia.
It was previously reported that the former head of the Kyiv Metro, Braginsky, was put on the wanted list.
