HACC to Hear Onyshchenko Case with Three Judges image

The High Anti-Corruption Court, with a panel of three judges, will hear the case against former MP Oleksandr Onyshchenko and financial manager Olena Pavlenko in the creation of a scheme to seize natural gas from JSC Ukrgazvydobuvannya.

To grant the motion of the defendant's defense attorney (Onishchenko - ed.) for a collegial review of the criminal proceedings. Based on the Principles of Using the Automated Document Management System of the Supreme Court of Justice of Ukraine and the Code of Criminal Procedure of Ukraine, to transfer a copy of the resolution to the Department for Ensuring the Functioning of the Automated System and the Electronic Court of the Document Management and Organizational Support of the Supreme Court of Justice of Ukraine for redistribution of the case to increase the composition of the court to three judges

– the decision states.

Let us remind you that Oleksandr Onishchenko is a person involved in the EBK base.

As is known, the anti-corruption court sentenced Onyshchenko in absentia to 15 years in prison, and Pavlenko to 12 years. They were banned from holding certain positions for 3 years and all property was confiscated. The judges also partially satisfied the civil lawsuit and recovered UAH 536.65 million from Onyshchenko and Pavlenko. The Appeals Chamber of the Supreme Court of Justice overturned this verdict and ordered a retrial. One of the grounds for the overturn was the separate consideration of Onyshchenko's case from the charges against Postny and other accomplices.

As a reminder, according to the prosecution, in 2013-2016 Onyshchenko committed a number of criminal offenses. As deputy chairman of the Verkhovna Rada fuel committee, he was aware of the demand and prices on the natural gas market in Ukraine and had control over the companies Nadra Geocenter LLC, Khas Firm LLC, and Karpatnadrainvest LLC, which are operators under joint activity agreements with Ukrgazvydobuvannya PJSC. This allegedly helped him create a scheme to seize the state company's funds from the sale of gas extracted from state-owned subsoil.

He involved his mother Ines Kadyrova and Valery Postny in the plan, who, according to the investigation, became co-organizers. In addition to them, other individuals were also involved who performed the roles assigned to them. As a result of the scheme, the criminal organization allegedly took possession of UAH 1.6 billion from Ukrgazvydobuvannya.

Previously, the High Anti-Corruption Court acquitted Tetyana Denisyuk, a judge of the Commercial Court of Kharkiv Region, of charges of abuse related to the gas case of former MP Oleksandr Onyshchenko.
