HACC Sets Bail for Vityuk image

SSU The High Anti-Corruption Court applied a preventive measure in the form of a bail of UAH 9.08 million to the former director of the cybersecurity department of the Security Service of Ukraine, Ilya Vityuk, whom the NABU and SAPO suspect of illicit enrichment.

This decision was made on September 4 by the investigating judge of the Supreme Court of Ukraine, Markiyan Galabala, reports "Word and Deed".

Prosecutor of the Specialized Anti-Corruption Prosecutor's Office Vitaliy Kravets requested that Vityuk be granted bail of UAH 42 million. In his opinion, the loss of this amount will ensure the suspect's proper procedural behavior. He also requested that a number of obligations be imposed, including: not to leave Kyiv and Kyiv region; surrender foreign passports; report a change of residence; and appear upon request.

In support of the suspicion, the prosecutor cited correspondence between Vityuk's wife and the realtor, which was found on the realtor's phone. She asked about possible bargaining regarding the price of the apartment and about the minimum payment through the bank. The SAPO prosecutor said that Vityuk's wife received a contract for an apartment from the realtor for a total amount of 600 thousand dollars, which is more than 22 million UAH, but they managed to bargain down to 21.4 million UAH. At the same time, in one of the clauses of the contract, by agreement of the parties, the estimated value was set at 12.7 million UAH.

Also, as the prosecutor claimed, the origin of the funds for the purchase of the apartment has not been established. Vityuk's wife indicated that she earned the funds as an individual entrepreneur while providing legal and consulting services, however, according to the investigation, such services were not provided. Before, as the investigation claims, the indicated funds were transferred to the accounts of the suspect's wife's individual entrepreneur by entrepreneur Kostyantyn Melnyk or companies controlled by him, which have signs of fictitiousness. Melnyk himself is a suspect in the case of misappropriation of funds of JSC "Ukrzaliznytsia". Vityuk's wife stated during interrogation that she had never contacted Melnyk.

In addition, the prosecutor spoke about the risk of influencing experts. In particular, NABU detectives ordered an examination at the Kyiv Scientific Research Institute of Forensic Expertise, but later it was withdrawn without execution. Later, the defense attorney sent the expert opinion to NABU, which NABU withdrew and asked not to conduct. During searches at the KRIFE, NABU detectives found evidence that this opinion was allegedly made retrospectively, and the price range in the examination was deliberately underestimated.

The defense objected to granting the motion and argued that the expert examination confirmed the value of the apartment at UAH 12.7 million. They also pointed to Vityuk's wife's income as an individual entrepreneur.

The motion is partially granted. A preventive measure in the form of a bail of UAH 9.08 million is applied to the suspect Vityuk Ilya Anatoliyovych.

As a reminder, NABU and SAPO reported suspicions of Ilya Vityuk, former director of the SBU cybersecurity department, in illicit enrichment. According to the investigation, in December 2023, the suspect purchased an apartment for UAH 21.6 million and registered it for his wife. At the same time, according to the contract, its value is UAH 12.8 million.
