Supreme Court upholds sentence of ex-judge Yushchuk image

The Supreme Court has upheld the verdict that found former judge of the Lutsk City District Court of the Volyn region Oleh Yushchuk guilty, but released him from liability due to the expiration of the statute of limitations. This was reported by the press service of the Specialized Anti-Corruption Prosecutor's Office.

As is known, the High Anti-Corruption Court sentenced retired judge Oleh Yushchuk to 3 years in prison for abuse of influence. This sentence was left unchanged by the Appellate Chamber of the High Anti-Corruption Court. However, the Supreme Court overturned the decision of the AP of the High Anti-Corruption Court and ordered a retrial of the appeal.

The statute of limitations has expired in the case, as abuse of influence is a minor crime, the statute of limitations for which expires 5 years after the commission. Therefore, the court left Yushchuk's sentence of 3 years in prison unchanged, excluded references to some evidence from the case, and released the former judge from punishment. The former judge himself filed a cassation appeal against these decisions.

On May 15, 2025, the Cassation Criminal Court of the Supreme Court ruled to leave unchanged the decision of the Appellate Chamber of the High Anti-Corruption Court dated April 22, 2024, by which the former judge of the Lutsk City District Court of the Volyn region O. Yushchuk was found guilty of committing a crime under Part 2 of Article 369-2 of the Criminal Code of Ukraine. The Supreme Court agreed with the conclusions of the appellate court. The decision is final and cannot be appealed.

As a reminder, as the court established, the judge of the Lutsk City District Court of the Volyn region, Oleh Yushchuk, promised the person against whom a report was drawn up for drunk driving for $500 to influence the decision of his colleague. The latter, in fulfillment of the agreements, was supposed to close the case against the violator. On March 15, 2018, the judge announced the need to transfer the object of the unlawful benefit to a third party, who turned out to be a lawyer.
