HACC appeal closes case of ex-head of Ukrmedproektbud

The Appeal Chamber of the Supreme Court of Ukraine has released from criminal liability the former director of the state enterprise "Ukrmedproektbud" Iryna Koval and closed the criminal proceedings against her due to the expiration of the statute of limitations, the court's press service reports, without specifying the name of the accused. According to media reports, it is Koval.

As is known, the Supreme Court of Justice sentenced the former director of the state enterprise "Ukrmedproektbud" Iryna Koval to 5 years in prison, and the former director of LLC "Ukrprofmed" Ihor Kuchma to 4 years. Both of them were immediately detained in the courtroom and sent to custody. On December 26, 2023, the Appeals Chamber of the Supreme Court of Justice overturned this verdict and acquitted the defendants .

The prosecutor of the Specialized Anti-Corruption Prosecutor's Office and the head of the SAPO Oleksandr Klymenko filed cassation appeals against this decision. The Supreme Court partially satisfied them and ordered a retrial of the case. Defense attorney Koval asked the court to release her from criminal liability.

The AP of the Supreme Court of Criminal Procedure of Ukraine considered the motions of the defense parties to release from criminal liability two defendants in the case of damages during the construction of "Okhmatdyt" and to close the criminal proceedings due to the expiration of the statute of limitations. Based on the results of the consideration, the panel of judges granted the motion of the defendant's defense counsel and released her from criminal liability on the basis of Clause 4, Part 1, Article 49 of the Criminal Code of Ukraine due to the expiration of the statute of limitations, closed the criminal proceedings on the basis of Clause 1, Part 2, Article 284 of the Criminal Procedure Code of Ukraine, the civil claim against the defendant was left without consideration

At the same time, the accused former director of Ukrprofmed LLC, Ihor Kuchma, refused the motion to release him from liability and asked to hear the case before the verdict.
