Anti-corruption court convicts former agriculture ministry official but waives sentence
The High Anti-Corruption Court found Olena Polishchuk, the former head of the state property management department of the Ministry of Agrarian Policy and Food, guilty of abuse of influence, but acquitted her of punishment due to the expiration of the statute of limitations.
As is known, the High Anti-Corruption Court found Polishchuk guilty and sentenced her to 8 years in prison. The Appeals Chamber of the High Anti-Corruption Court overturned the verdict and ordered a retrial. The High Anti-Corruption Court convicted Polishchuk again, but under Part 2 of Article 369-2 of the Criminal Code of Ukraine (abuse of influence). She was sentenced to 3 years in prison and released from punishment due to the expiration of the statute of limitations.
To find (Polishchuk) guilty of committing a criminal offense under Part 2 of Article 369-2 of the Criminal Code and to sentence her to 3 years of imprisonment. To count (Polishchuk)'s detention from August 2 to August 9, 2016, as part of the term of serving the sentence, at the rate of one day of detention for two days of imprisonment. On the basis of Part 3 of Part 1 of Article 49, Part 5 of Article 74 of the Criminal Code, to release (Polishchuk) from the sentence under Part 2 of Article 369-2 of the Criminal Code due to the expiration of the statute of limitations
