Supreme Court Upholds Moskvych and Tymofiyuk’s Verdict

The Supreme Court upheld the verdict, which found the former director of the state-owned enterprise "Lutsk Bread Plant No. 2" Stepan Moskvych and the former head of the enterprise's elevator Leonid Timofiuk guilty of embezzling UAH 56 million in grain.
As is known, the anti-corruption court sentenced the former director of Lutsk KHP No. 2 Stepan Moskvych to 10 years in prison, and the former head of the enterprise's elevator Leonid Timofiuk to 7.5 years. They were also sentenced to additional punishment in the form of confiscation of property. The Appeals Chamber of the HACC left this verdict unchanged. The defense filed an appeal.
The Cassation Criminal Court of the Supreme Court decided to leave unchanged the verdict of the Supreme Court of Cassation of Ukraine dated March 16, 2023 and the ruling of the AC of the HACC dated March 22, 2024, by which the former director of the State Enterprise "Lutsk KHP No. 2" S. Moskvych and the former head of the elevator L. Tymofiyuk were found guilty of embezzlement of the property of PJSC "Agrarian Fund", namely 26 thousand tons of grain for a total amount of UAH 56 million. The Supreme Court agreed with the arguments of the SAPO prosecutor, rejected the cassation appeals of the defense and confirmed the legality of the court decisions

Recall, according to the prosecution, PJSC "Agrarian Fund" (100% of the shares belong to the state) in November 2013 transferred grain for safekeeping to Lutsk KHP No. 2. Its then-head Moskvich, without obtaining permission from the grain owner, decided to ship it to commercial entities without payment from them. The shipment was provided by the elevator manager at that time, Timofiuk. In this way, during February-June 2014, more than 26 thousand tons of grain belonging to PJSC "Agrarian Fund" were taken out of the elevator of Lutsk KHP No. 2, which caused the enterprise losses in the amount of more than 56 million UAH.
