HACC Appeals Chamber Orders Valuation of Migration Official’s Asset
The Appeals Chamber of the High Anti-Corruption Court has appointed an appraisal and construction expertise in the case of a complaint against the decision to confiscate part of the value of a shopping center in the amount of UAH 7.3 million, which belongs to the wife of the head of Khmelnytskyi Department No. 1 of the State Migration Service in Khmelnytskyi region, Vadym Sidletskyi, Victoria.
As is known, the anti-corruption court recognized a shopping center in the village of Chorny Ostriv near Khmelnytskyi as an unfounded asset. The specified shopping center belongs to the wife of an official of the Khmelnytskyi SMS Sidletskyi. Its total area is 913.8 square meters, and its cost is estimated at UAH 13.7 million. The court decided to recover part of the asset's value in the amount of UAH 7.3 million from the state's income.
The defendant filed an appeal against this decision. The representative also requested an expert assessment of the cost of building a mixed-use store with a cafe and office space.
The request of the defendant's representative to appoint a judicial expert examination shall be partially granted. To appoint a judicial valuation and construction expert examination in the civil case. To entrust the conduct of the examination to the experts of the Khmelnytskyi branch of the Kyiv Scientific Research Institute of Forensic Expert Examinations of the Ministry of Justice of Ukraine.
The court set the following questions for the experts to decide: what is the cost of building a mixed-use store with a cafe and office space as of September 15, 2023; what is the cost of building the specified facility as of September 15, 2023, including building materials, structures, equipment, construction work and other costs directly related to the creation of the facility; what is the retrospective reproduction cost (the cost of creating a new facility identical to the research object) of the above-mentioned facility as of September 15, 2023.
