Anti-corruption court refuses to suspend Judge Shcherbyna’s trial

The High Anti-Corruption Court refused to suspend the hearing of the criminal proceedings on charges of Oleksandr Shcherbyna, a judge of the Pavlohrad City District Court of Dnipropetrovsk region, in receiving illegal benefits, despite his mobilization.
As indicated, Shcherbina's lawyer requested to stop the hearing of his client's case in connection with mobilization. However, the judges established that the accused was recognized as fit for service in rear positions and only voluntarily agreed to join the combat. In addition, Shcherbina did not inform the command about the existence of charges brought against him for committing a serious corruption criminal offense. The accused also has access to the telephone and has already communicated with his lawyer in this way. Moreover, all written evidence has been examined in the case.

As is known, the court applied a preventive measure to the suspect Judge Shcherbyna. He was given the following obligations: to appear upon first demand; not to leave the Dnipropetrovsk region without permission; to report any change in his place of residence and/or place of work; to refrain from communicating with a witness in criminal proceedings.
